Terms & Conditions

§ 1 Scope

These General Terms and Conditions apply to all contracts for the performance of gospel workshops between the artist Adrienne Morgan Hammond (hereinafter "Artist") and the respective organiser (hereinafter "Organiser"). Deviating terms of the Organiser shall not apply unless the Artist expressly agrees to their validity in writing.

§ 2 Fee

The amount of the fee and the payment terms are agreed separately in the respective individual contract.

§ 3 Breach of contract / contractual penalty

If the performance is cancelled due to breach of contract, the party at fault shall pay the other party a contractual penalty equal to the fee agreed in § 2.

§ 4 Cancellation by the Organiser

If the event is cancelled by the Organiser, the Organiser shall bear the following cancellation costs:

• Cancellation up to 8 weeks in advance: free of charge
• Cancellation up to 4 weeks in advance: 25 percent of the agreed fee (see § 2)
• Cancellation up to 2 weeks in advance: 50 percent of the agreed fee (see § 2)
• Later cancellation: 100 percent of the agreed fee (see § 2)

The receipt of the written cancellation by the Artist is decisive for calculating the deadline.

§ 5 Force majeure

In the event of force majeure, unavoidable official measures or illness of the Artist, as well as in cases of strikes and/or failure or significant delay of public transport that make it impossible to provide the Artist, technicians or the required equipment, the Artist is released from the performance obligation. No claims of any kind can be derived from this; each contracting party shall bear its own expenses. Both parties will endeavour to arrange a replacement date.

§ 6 Final provisions

Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The law of the Federal Republic of Germany shall apply.
